A pan masala business in India now has to be built as a licensed, heavily taxed manufacturing unit, because that is what the 2026 rules have made it. Three things decide whether it works. The product must be free of tobacco and nicotine. The unit needs an FSSAI (Food Safety and Standards Authority of India) food licence. And your costing must carry the tax load that began on 1 February 2026, which is far heavier than most older guides assume.
The version to build is sada (plain) or meetha (sweet) pan masala: areca nut (supari), catechu (kattha), lime, cardamom and flavours. Plan for a project of about ₹2 crore once stock and credit are counted, not a pouch machine and a few lakh rupees. Among food processing business ideas, this one is unusual because its rules have moved repeatedly this year.
Can a pan masala unit add tobacco? What the law allows
No. Food safety regulations say tobacco and nicotine shall not be used as ingredients in any food product, and states use that rule to ban gutkha and tobacco-laced pan masala. The orders are renewed every year: Tamil Nadu's runs for a further year from 23 May 2026, as its gazette notification shows. In the Supreme Court's 2016 gutkha case (Central Arecanut Marketing Company v. Union of India), the amicus flagged plain pan masala sold beside chewing tobacco in pouches meant to be mixed, and the Court directed the authorities to enforce the ban.
Keep tobacco out of your premises, your distributors' bundles and your branding. Plain pan masala is not what these orders target, but each state issues its own, so read yours before ordering machinery.
Which licences and taxes does a pan masala unit carry in 2026?
| Requirement | What it is | Position in October 2026 |
|---|---|---|
| FSSAI licence | Food business registration or licence; the type depends on turnover and scale | Apply on FoSCoS before production starts |
| GST | 40% on pan masala from 1 February 2026, charged on the highest retail price printed on the pack; no compensation cess any more | In force |
| Health Security se National Security cess | Monthly charge per packing machine, set by its rated speed and pack weight, not by output: ₹1.01 crore for the lowest band (up to 500 pouches a minute, pouch up to 2.5 g) and ₹11 lakh per factory if fully manual (PIB factsheet) | Struck down in July 2026, see below |
| Other registrations | GST registration, Udyam, local trade licence, Legal Metrology declarations on the pack | Standard for any packed food |
The cess falls on whoever owns or runs the machines, not on distributors or retailers. In July 2026 the Karnataka High Court (Dhariwal Industries v Union of India) upheld Parliament's power to levy it but struck down the Act, Rules and notifications because the levy assumes output from machine capacity instead of actual production (ruling summary). The Centre can still appeal or legislate again, so cost your plant both ways.
Pan masala business profit margin: what does a plant cost and what is left?
NPCS project reports give a clear sense of scale. In two NPCS Pan Masala reports, plant and machinery is a small slice of the cost of project:
| NPCS report | Capacity | Plant and machinery | Cost of project | Return | Break-even |
|---|---|---|---|---|---|
| Pan Masala, daily-capacity version | Three variants, 165 to 170 kg a day each | ₹12 lakh | ₹191 lakh | 27% | 54% |
| Pan Masala, annual-capacity version | Three variants, 99,000 to 102,000 kg a year each | ₹35 lakh | ₹226 lakh | 28% | 54% |
Machinery is ₹12 lakh of ₹191 lakh (about 6%) in one and ₹35 lakh of ₹226 lakh (about 15%) in the other. The balance typically covers building, raw material stock and credit to distributors. Both reports include a zarda variant, which usually contains tobacco and cannot be made under the rules above, so read the figures as scale indicators. Neither summary shows how the 2026 tax and cess enter the numbers.
Take the cess's lowest band as an example, assuming the machine runs at its rated 500 pouches a minute for one 8-hour shift, 26 days a month, and the pouch sells at ₹5:
- Cess per year: ₹1.01 crore × 12 = ₹12.12 crore.
- Pouches per month: 500 × 60 × 8 × 26 = 62.4 lakh.
- Cess per pouch: ₹1.01 crore ÷ 62.4 lakh = about ₹1.62, close to a third of the ₹5 price, before GST, nut, film, labour or trade margin.
Machines rarely run flat out, so the real figure is higher. A wholly manual unit pays ₹11 lakh a month per factory, or ₹1.32 crore a year. Build your margin from the printed price downward: take out GST, distributor and retailer shares, the cess per pouch and your making cost, and see what remains.
How is pan masala made? The process step by step
- Buy and clean areca nut. Remove stones and foreign matter, and grade by size.
- Cut. Slice the nut into uniform pieces.
- Dry and roast. Bring moisture down so the blend keeps on the shelf.
- Coat. Tumble the pieces with catechu, lime and permitted flavours. NPCS's report on tobacco-free pan masala technologies describes food-grade coating materials in place of magnesium carbonate or dolomite.
- Blend. Mix in cardamom, fennel, menthol and other flavours until the batch is even. For how whole spices are cleaned and graded, see spice processing.
- Sieve and check. Remove dust and fines, then sample for taste, moisture and foreign matter.
- Pack and label. Fill moisture-barrier pouches, and print the batch, date, retail price and FSSAI licence number.
Which machines does a pan masala plant need?
The pouch packer is the machine to specify most carefully, because its rated speed and pack weight set your cess band.
| Machine | What it does | Ask the supplier |
|---|---|---|
| Supari cutting machine | Slices nut into uniform pieces | Output per hour for your cut size |
| Dryer and roaster | Lowers moisture, develops flavour | Batch size and temperature control |
| Coating and mixing drum | Coats nut with catechu, lime and flavour; blends spices | Food-grade contact parts, batch capacity |
| Sieving unit | Removes dust and fines | Mesh sizes available |
| Automatic pouch packing machine | Forms, fills and seals pouches | Rated speed in pouches a minute, pack weight range |
How does a new pan masala brand get onto the shelf?
Pan masala reaches buyers through distributors, then kirana and paan shops. You compete for that counter with established pan masala manufacturers; DS Group's Rajnigandha is a name every retailer knows. Start with one district, one distributor you can fund on credit, and a printed price you can defend at the counter. If a pack shows more than one price, the highest counts for GST, so an inflated MRP raises your own tax bill.
What to do in your first 90 days
- Read your state's current pan masala notification and confirm the recipe has no tobacco or nicotine.
- Ask a tax advisor where the cess stands, and cost the plant with and without it.
- Apply for the FSSAI licence on FoSCoS and take an Udyam registration. Before building a finance plan, check whether your bank or an MSME scheme accepts pan masala at all.
- Get machine quotes that state rated speed and pack weight.
- Run a feasibility study on both tax scenarios before signing any order.
NPCS has prepared project reports since 1994 for clients in 85 countries. An NPCS project report on pan masala sets out process, machinery, raw materials, cost of production, profitability, break-even and cash flow in the format lenders expect; the detailed project report guide explains it.
Frequently asked questions
Is selling gutka legal?
No. Gutkha and pan masala containing tobacco or nicotine are banned through state notifications under food safety law, and the orders are renewed each year. Tobacco-free pan masala is not covered by those orders, but each state issues its own, so check your state's current notification before you sell there.
Is a pan masala business profitable in 2026?
It depends on volume and on how the cess case ends. GST at 40% and, while it applies, the capacity-based cess take a large share of each pouch. Work out the margin from the printed price downward, as shown in the cost section, before you buy any machinery.
What is the GST rate on pan masala?
It is 40% since 1 February 2026, charged on the highest retail price printed on the pack, with no compensation cess. Before that date the rate was 28% plus compensation cess. Because the tax follows the printed price, the price you print is also your tax base.
Can I avoid the cess by packing by hand?
No. Under the cess as drafted, a wholly manual unit pays a fixed ₹11 lakh a month per factory, so hand-packing does not avoid it. The levy was struck down by the Karnataka High Court in July 2026, so confirm its current status before planning.
